1. Who these terms are with

Garcia Builder Fitness is the trading name used on this website. The legal person or entity that operates the website and enters coaching contracts is pending owner verification. Contact: andre@garciabuilder.fitness.

2. Using the website

You may use the public website for lawful personal purposes. You must not interfere with the website, attempt unauthorised access, introduce malicious code, scrape protected areas, misuse another person's account, submit false information, or use content in a way that infringes rights or breaks the law.

3. Educational fitness information

Public articles, calculators, downloads, videos and assessment results provide general educational information. They are not a diagnosis, medical advice, physiotherapy, emergency support, or a substitute for advice from a qualified health professional who understands your circumstances.

4. Starter assessment limitations

The starter assessment uses seven answers and predefined recommendation rules to suggest a general starting direction. It cannot examine you, identify a medical condition, verify every fact supplied, prescribe an individual programme, or guarantee suitability or results. Completing it does not itself create a paid coaching contract.

5. Eligibility and minimum age

You must be at least 18 to complete the assessment, create a client relationship through this site, or purchase coaching. You must have legal capacity to enter a contract and provide accurate, current information.

6. Coaching scope

The exact coaching service, duration, communication, check-in arrangements, training updates, nutrition support and fees are those confirmed in the applicable offer, checkout and written onboarding information. Public descriptions are invitations to enquire and do not guarantee acceptance. Garcia Builder Fitness may decline or pause coaching where the service is unsuitable or outside its competence.

7. Your responsibilities and medical clearance

• Provide accurate information about relevant experience, injuries, symptoms, health conditions, medication and professional advice.
• Follow safe equipment instructions and stop activity if you experience concerning pain, dizziness, faintness, chest discomfort or another unexpected symptom.
• Seek medical clearance before starting or changing exercise or nutrition where you have a condition, symptoms, are pregnant/post-partum, have been advised to do so, or are unsure whether participation is safe.
• Use your judgment and contact an appropriate health or emergency service when necessary. Coaching messages are not monitored as an emergency channel.
• Understand that results vary with individual circumstances, health, adherence, recovery and other factors; no outcome or timeframe is guaranteed.

8. Accounts and communications

You are responsible for keeping account credentials secure and notifying Garcia Builder Fitness of suspected unauthorised use. Service communications may be sent to administer an assessment, booking, account, purchase or coaching relationship. Optional marketing is governed separately by your marketing choice.

9. Intellectual property

Unless stated otherwise, the website design, brand, text, assessment, training resources, downloads, graphics and coaching materials are owned by or licensed to Garcia Builder Fitness. A purchased or supplied resource is licensed for your personal, non-commercial use. You may not reproduce, sell, publish, redistribute or create a competing service from it without written permission. You retain ownership of material you provide, subject to the permissions needed to deliver the service.

10. Payments, renewal, cancellation and refunds

Prices, currency, billing interval, what is included and payment timing must be shown in the relevant offer and checkout before an order is placed. Payments may be processed by Stripe or another identified provider under its own terms. Do not send payment-card details through the assessment or ordinary email.

A recurring plan renews at the interval shown at checkout until cancelled. You may cancel a future renewal before the next billing date using the management link supplied with the purchase or by emailing andre@garciabuilder.fitness. Cancellation stops future renewal; access already paid for ordinarily continues to the end of the current billing period unless the purchase terms or applicable law provide otherwise.

Nothing in these terms removes mandatory consumer rights. Where distance-contract cancellation law applies, a consumer normally has 14 days after the service contract is made to cancel without giving a reason. If you expressly ask for coaching to begin during that period, any lawful refund may be reduced by a proportionate amount for service already supplied. The cancellation right is lost after the service is fully performed during that period only where the law permits and the required express request and acknowledgement were obtained. Refunds are also provided where required by law, including for a billing error or service not supplied as agreed.

To cancel within a statutory cancellation period, send an unambiguous statement by email. You may use: “I give notice that I cancel my contract for [service], ordered on [date]. Name: [name]. Address: [address]. Date: [date].” Keep a copy of the notice. The verified contracting identity and physical address must be inserted in section 1 before sales open.

11. Third-party services and links

The website may link to services such as Calendly, Stripe, My PT Hub, Instagram, Facebook and WhatsApp. Their availability, security and content are controlled by their providers. A link is not a guarantee or assumption of responsibility for the third-party service.

12. Liability framework

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including applicable consumer rights. Subject to that rule, Garcia Builder Fitness is not responsible for loss caused by inaccurate or withheld information, ignoring safety instructions or professional advice, unauthorised account use outside its reasonable control, third-party service failure, or use of general educational material as individual medical advice. The final contracting entity and any lawful financial limitation require legal approval before publication.

13. Privacy

The Privacy Notice explains personal-data handling. The Cookie Policy explains website storage and optional tracking choices.

14. Availability and changes

The website may be changed, suspended or corrected, and no uninterrupted availability is promised. Material changes to these terms will be shown with a revised date. Changes will not remove rights that have already arisen under applicable law or an agreed service without a lawful basis.

15. Governing law and disputes

Pending owner and legal verification before publication. The governing law, courts and any consumer dispute mechanism must reflect the verified contracting party, place of establishment and mandatory consumer protections. Contact Garcia Builder Fitness first so a concern can be investigated.
